FEDERAL MINISTRY OF WORKS ADOPTS FUNDING PRIORITIZATION FRAMEWORK ON NNPCL INHERITED TAX CREDIT PROJECTS NATIONWIDE.
-PROMOTES NIGERIA FIRST POLICY, SAYS CONTRACTS BELOW ₦20 BILLION TO BE DONE BY INDIGENOUS CONTRACTORS

As part of strategic plans towards sustainability in project funding and execution and in pursuance of the directive of the President of the Federal Republic of Nigeria, His Excellency, Bola Ahmed Tinubu, GCFR on strategic and systematic funding of inherited NNPCL funded projects, the Federal Ministry of Works has adopted funding prioritization framework to ensure the continued execution of road projects hitherto funded by Nigerian National Petroleum Company Ltd (NNPCL) under the Road Infrastructure Development and Refurbishment Investment Tax Credit Scheme. The Honourable Minister of Works, His Excellency, Sen. Engr. Nweze David Umahi, CON made this disclosure during his inspection visit to the ongoing dualization of the East-West Road (Section IIIA) from Eleme Junction, Port Harcourt to Onne Junction in Rivers State handled by Messrs RCC Nig Ltd dated 9th September 2025.

Speaking during his visit, the Honourable Minister stated that the Federal Ministry of Works had compiled all the NNPCL inherited Tax Credit projects for strategic priority funding, noting that the most critical projects within the national economic corridor would receive precedence in the hierarchy of prioritization. “We are inspecting projects of federal government in Rivers State, and this particular one is the dualization of Eleme Junction to Onne Port Junction by RCC. Recall that one carriageway was completed and commissioned, even though there are a few things we ordered afresh like the retaining wall and hanging drainage. For the second carriageway with some bridges and flyovers, work has started on it. Let me say that this is part of the NNPC Tax Credit that has been stopped in terms of funding by NNPC. But graciously, we have compiled all the NNPC inherited Tax Credit projects, and we presented as Ministry of Works to Mr. President. And Mr. President has graciously directed that none of such works should stop now. However, as Ministry, we are going to do prioritization of the projects and look at the most critical of these projects within the national economic corridor like this one. And we are going to put it forward for immediate funding because the President directed that none of such projects should stop now.”

He admonished contractors handling road projects under the Federal Ministry of Works to ensure speed, quality, compliance with specification and sustainability in project delivery and cautioned that the attention of the anti-graft agencies would be called to any case of violation of the regulations or terms and conditions set out under the contract of every project handled by the Federal Ministry of Works. He stated, “I have also noticed in some of the projects in Rivers State, and same with the Six Geo-Political zones, that contractors go ahead to put stone base and put binder course of asphalt, sometimes over 20 kilometres and leave the binder unprotected without putting wearing course. The binder is like a reinforcement to the road architecture. The wearing is the sealant that doesn't allow water to go beyond the surface. And so when you now put stone base, which has dust as designed, and you put binder, which is like a reinforcement, and you see that the composition of the binder asphalt has bigger stones, and it has holes, so the water penetrates. The moment it gets to the stone base, which has some dust, the road fails. It may technically look safe, but with time, it will definitely fail. And we've seen it in a number of roads we inspected. And what I've directed the Controller to do, and it's going to be nationwide, is that when you are putting binder and you have left it for more than two months, we are going to redo the certificate and remove all the binder and remove the stone base.” He directed that henceforth any project below the contract sum of ₦20 Billion would not be given to expatriate firms, and this he said is part of measures to promote the Nigeria First policy of Federal Government of Nigeria.

He commended the construction company handling the Eleme - Onne project, Reynolds Construction Company (RCC) for the quality of work so far done and for working on the project despite the fact that NNPCL has stopped funding the project, but frowned at the slow pace of work which they said was affected by the rainy season. He restated that 15th December 2025 remains the agreed deadline for the project’s completion with no extension or Variation of Price (VoP) allowed. “On this project of Eleme Junction, the quality of the work is excellent. The pace of the work is totally not acceptable. And let me make it very, very clear to the contractor that this project can never be reviewed by a kobo. Neither can there be any variation of price or any other claims.” He expressed dismay over the destructive habit of packing heavy duty vehicles on the road by drivers and warned that forthwith punitive measures would be taken against such perpetrators. “Our roads are not designed to carry these heavy trailers that are parking on the road. And the press should help us on that. When I was coming yesterday all the way from Aba to here, I saw that the trailers are taking over the entire roads, putting their waste, destroying the pavements, and so on and so forth. So I'm going to write to our dear Governors to see what they could help us to do about it, and will also complain to the Inspector General of Police. Let us see what we can do about it. Mr. President is doing everything possible to right the wrongs in terms of road construction. We are doing quality roads now that are going to last from 50 to 100 years. But it's being destroyed by ourselves.”

Earlier, the Federal Controller of Works in River State, Engr. Enwereama Tarilade (Mrs.) said the contractor handling Eleme- Onne road had completed the 15km Eket bound on the right carriageway and had moved to the left carriageway which is Port Harcourt bound for which 1km stretch had already been done on Continuously Reinforced Concrete Pavement (CRCP). 

Projects visited by the Honourable Minister include, the rehabilitation of Enugu – Port Harcourt, Abia/Rivers State, contract No: 6252 being handled by China Civil Engineering Construction Company Limited (CCECC), the upgrading of the 15km section of the East-West Road (Section 111A) from Port Harcourt (Eleme Junction) to Onne junction in Rivers State, contract No: 701 being handled by Messrs. RCC Nig. Ltd and multiple sections of the Enugu-Port Harcourt Expressway, including the sections handled by Arab Contractors and China Civil Engineering Construction Company Limited (CCECC).

FEDERAL MINISTRY OF WORKS GIVES ULTIMATUM TO CONTRACTORS HANDLING THE DUALIZATION  OF LOKOJA-BENIN ROAD,  OBAJANA  JUNCTION- BENIN IN KOGI AND EDO STATES TO SIGN THE REVIEWED CONTRACT OR FACE JOB TERMINATION - AS HON MINISTER DIRECTS THE MINISTRY TO WITHIN 7 DAYS  AUDIT ALL  ONGOING  PROJECTS, INCLUDING PERSONNEL  AND EQUIPMENT The Honourable Minister  of Works, His Excellency,  Sen. Engr. Dr. Nweze David Umahi CON has directed  the   contractors handling  sections I- IV of Lokoja- Benin, Obajana Junction- Benin roads in Kogi and Edo States to immediately  sign the new contract  as reviewed under the Renewed Hope administration  of  President Asiwaju Bola Ahmed Tinubu GCFR or face the termination of their job by the Federal Ministry of Works in accordance with the condition of service.  This directive was given to the contractors  in a meeting  with the  representatives of  Mothercat  Ltd, CCECC Ltd, Dantata & Sawoe Ltd, CGC Ltd and RCC Ltd held on 25th April 2024  at the Ministry's Headquarters, Mabushi-Abuja.  He further directed  the Ministry  to, within  7 days , carry out a comprehensive audit of the ongoing  projects with a view to  knowing  the  status of work done, the capacity  of personnel  and equipment being used by the contractors. Speaking  during the meeting, the Honourable  Minister frowned at the pranks of the contractors who were part of the process of re-scoping and reviewing the contract specifications but failed to sign the review  contract  documents after signing that they would do the job based on the new specification.  He said “The project was initially N121 billion, but before the administration of President Ahmed Bola Tinubu, the project was already reviewed to about over N870 billion.  When I came in as Minister, I saw that the project was over-bloated, and I refused to take the No Objection to FEC. I had to go through the road  myself, and I realized that some sections of the road could not survive asphalt.  So, we started meetings that took us over five months with all the contractors, and in the meetings, we agreed to re-scope the project. We re-scoped the project where we said okay, the new lanes should be done on concrete and the other ones done on asphalt.  We kept the contracts up and we all signed the documents and based on signing the documents, we took it to BPP and from BPP we went to FEC, and before we went to FEC, we demanded for them to approve that they can do the job.  They all gave us letters of approval.” He  wondered  why  contractors were given jobs without having the required manpower and equipment to do the job, and warned that henceforth any contractor signing a contract must sign alongside the basic rate and timeline.  He said,” So the position of the government is that if you are not signing the contracts between today and tomorrow, you will forgo the jobs. You can go to court. We will not enter into any condition for further negotiation.  This contract is over N2 billion per kilometer. You don't have equipment to do the work. Let me even assure you that if you are signing the contract, you will sign it alongside the basic rates. You sign it alongside the timetable, and you deploy in three sections, or I will terminate the job. Enough of playing with the psyche of the people."  He further stated that the Ministry would  not allow  any contractor  to hold the country to ransom or to impose their conditions  on the Ministry. "You don't want to work, leave the job. It's not compulsory that you must be the one to do the job. You cannot be on site, and the people are dying. The vehicles are falling down, and you're playing politics with the lives of the people. And we fold our hands and leave you for what? You can't be on site....So if you are not working, pack your things out of that site." In his remarks,  the Director,  Highways (SP) South, Engr. C.A Ogbuagu  gave account  of  the  technical processes undertaken by the Ministry before  Federal  Executive Council approved the  augmentation of the  project,  which the contractors accepted,  and letters of award were given to them. He wondered why the contractors refused  to sign the new document. He said," After the FEC's approval of the argumentation, the legal department was brought in so that this new contract will now be executed so that work will continue on site. So, for about two weeks now, the draft addendum has been with the contractors, and none of them has positively responded, except  RCC." The CGC in his reply, expressed commitment to the directive of the Hon. Minister and said, "for our side, and firstly for our section, and currently we are seriously working.  And secondly, we have a sent the draft to the Head Office And there is any issue, we have answered them and may be later tomorrow morning, we can get the approval from them so we can go ahead."  It is hoped that the other contractors will sign the new contract latest Monday 29th April, 2024. and mobilize effectively to the site.   ...

BODO-BONNY ROAD:  FG ORDERS JULIUS BERGER TO RETURN TO SITE WITHIN 14 DAYS OR FACE SANCTIONS The Federal government has ordered the contractor handling the Bodo- Bonny road construction to return to site within 14 days or risk appropriate sanctions. Works Minister, His Excellency, Distinguished Sen. Engr. (Dr) David  Umahi gave the marching order today at a meeting with the handlers of the road project, Julius Berger  PLC , as well as representatives of Nigeria Liquefied Natural Gas NLNG and Royal Fathers from Bonny Kingdom  and  other members of host  communities in Abuja. According to the Minister, the Bonny-Bodo road contract which was initially awarded at the cost of N120 billion in 2015, was later varied at N199 billion with a completion dateline of December 2023, which has since elapsed. The Minister deplored the unilateral stoppage of work by Julius’ Berger, describing the action as unacceptable. While rejecting in total, Julius Berger’s request for variation based on fluctuations in exchange rate and increasing cost of material, the Minister said government does not award contract based on exchange rate. He pointed out that no contractor will come to government for a downward review of the cost of any project if the exchange rate becomes one naira to one dollar, adding that government cannot anchor contract cost based on exchange rates variations. Senator Umahi was particularly unhappy that the timelines for the completion of the project were not adhered to, maintaining that if the project were  completed in December 2023,   as contained in the contract agreement , issues  of high exchange rate and increasing cost of materials would not have arisen ‘ He however promised that he would make a presentation to Mr President and commander in Chief His Excellency Bola Ahmed Tinubu for a marginal augmentation to ensure that the project is completed on or before December 2024, particularly in the Spirit of the Renewed Hope Agenda and the love President Tinubu has for Bonny Kingdom and other host communities in the Niger Delta Region. Earlier in his presentation, the Managing Director, Julius Berger Plc    Engr Dr. Lars Richter called for the variation of the contract which he said has become necessary in view of the declining value of  the Naira and rising cost of construction materials in the country. The Managing Director drew the attention of the Minister to the time lag when the contract was awarded in 2015 when the exchange rate was N305 to a dollar, adding that the cost of building materials has since risen by over 1000%. Contributing, the Deputy Managing Director of NLNG, Olakunle Osobu pointed out that the contract which is being funded through the Tax Credit Scheme is intended to complement the Renewed Hope Agenda of the current administration, calling on all parties to the project to remain patriotic as well as make the necessary sacrifices for the actualisation of the project.     On their part, Roya Fathers of Host Communities led by Chief Abel Attoni, Palace Secretary, Bonny Kingdom expressed profound gratitude to President Bola Ahmed Tinubu over the decision of the Renewed Hope administration to ensure that Bodo-Bonny road is completed. His Royal majesty applauded the commitment of the Works Minister to the road project especially coming at a time the Nation is experiencing economic difficulties. ...

Those Criticizing the Ongoing Lagos- Calabar Coastal Highway Project Being  Done by  The Renewed Hope Administration Of President Asiwaju Bola Ahmed Tinubu  Either Have Little Knowledge of the Concept of EPC+F On Project Financing Or  Are Deliberately Sacrificing The Cause Of  Development  At The Altar Of Politics The trending posts of   criticisms by some notable  politicians on the propriety and priority of the Lagos-Calabar coastal highway project being executed  by the Renewed  Hope administration  of His Excellency President Asiwaju Bola Ahmed Tinubu GCFR are no doubt baseless thoughts of critics who are either bereft of the knowledge of the workings of the project  initiative or they deliberately  want to sacrifice the modest developmental efforts  of Mr. President  at the altar of  their political ambitions. It is unthinkable  that such highly  placed people fail to understand  the various  elucidations provided  by the Honourable Minister  of Works,  His Excellency,  Sen Engr Nweze David Umahi CON  on when the project  was conceptualized, the various  administrations that attempted   but failed to carry out the project, the economic  and technical  considerations that gave rise to the commencement  of the project under the Renewed Hope administration, the funding  and procurement details  and indeed the dimensions, importance, priority and propriety of the projects  in the national developmental trajectory. For the avoidance  of doubt,  the Lagos- Calabar coastal highway  project is being done under EPC +F. What does this type of funding  entail? This is a project financing mechanism in which EPC+F contractors also arrange financing for the project. EPC+F is Engineering, Procurement  and Construction plus Financing. Engineering  here includes design and specification. This initiative provides  a fixed  price, fixed date, and transfers risks to the contractor. This type of funding requires only a counter- part funding  from the Federal Government. Such funds  are sourced  by contractors where they have confidence  in the  economic policies of government, which essentially entails  allowing  the participation of the private  sector  in the road infrastructure  development through  PPP or EPC+F.   In the recent  Inauguration  of the Committee  on Compensation  of owners of properties that will be affected  by section 1 of the Lagos- Calabar Coastal Highway, the Honourable Minister emphasized the nature of the project funding  and the workings of EPC + F when he said, "And graciously, Mr. President had approved that this section three will start from Calabar, which is the end point of the project, and start running towards Akwa Ibom. So, the 700 km is procured  under phase one, in phases, and it's EPC +F. EPC+F is engineering, procurement, construction, and finance. And so, under this kind of arrangement, the contractor is expected to bring in a certain amount of money, and Federal Government is expected to pay certain counterpart funding." No patriotic  Nigerian  should discourage  this kind of project  where funding is substantially  from the contractor. There is no doubt  that Mr. President  is aggressively  tackling  the backlogs  of uncompleted  road projects. In the 2023  Supplementary Budget,  Mr. President  approved funds for intervention on the over 260 dilapidated roads nationwide.  The 2024 appropriation  made provision for capital  investment  on our critical  roads across  the 6 Geo- political  zones of Nigeria. The Honourable Minister  has already  made a great difference  in the road infrastructure development  roadmap of this administration through his new innovations on road construction  and rehabilitation, his power of supervision, and his contract negotiation power which  is second  to none in the history  of the Federal Ministry of Works. He has been touring around and supervising   the various  ongoing  projects  of the  federal government, and the difference  is already  there. The people  are testifying of the quality  and speed of road projects being  executed by the Renewed Hope administration. He has proven track records on road  infrastructure development.  He is not into rhetorics like many politicians who talk high but can do only less. The administration of President  Tinubu  is doing roads that will stand the test of time. The  roads he is fixing  will  facilitate economic  recovery.  The patriotic  Nigerians are already  applauding  the good efforts of Mr. Presidentt, but professional  politicians  are busy criticizing  a landmark  project  that will launch Nigeria into the league  of the best economies of the continent.  On the importance  of the Lagos-Calabar coastal highway project  to the economy  of the  nation, it is clear that the coastal highway, when completed, will foster national economic growth. Notably,  all roads in the country are  important as reflected by the interventions of this administration on road rehabilitation across the nation, but the coastal highway offers much more economic benefits to the nation because  of its connectivity  to the North  and South through  the existing spurs. The road, when completed, has the potential to increase Nigeria’s GDP and trigger industrialisation, create trade, enhance the  transportation  of goods and services, and  safety of road users.The road is going to be the biggest super highway in Africa in terms of the structure and solidity as we all as utility value, having ten lanes with a rail track designed for concrete technology, covering 700 kilometers. It is going to attract foreign direct  investment to Nigeria, and it is going to trigger economic development. It is going to develop the potential of our coastal businesses, especially  at the local economic corridors, and boost tourism and marine businesses.  ...

FASHOLA CONDOLES WITH  ADENIRAN OGUNSANYA FAMILY OVER DEATH OF FORMER SSG

The Minister of Works and Housing, Mr. Babatunde Fashola, SAN has condoled with the Adeniran Ogunsanya Family, the Government and people of Lagos State over the passage of the former Secretary to the State Government, Princess Adenrele Adeniran Ogunsanya.

Expressing deep shock and sadness over the death of Princess Adeniran Ogunsanya, who served as Secretary to the State Government from 2007 to 2011 during his first tenure as Governor of Lagos State, Fashola said that her passing was a huge loss not only to the historic town of Ikorodu and Lagos State but to the country in general.

In a Press Release signed by the Special Adviser on Communications to the Hon. Minister, Fashola noted that Princess Adenrele Adeniran-Ogunsanya’s single minded devotion to public service, politics of inclusion and women advocacy as well as her humaneness would be sorely missed by all.

A scion of the famous Adeniran-Ogunsanya family whose patriarch served meritoriously as Minister in the First Republic, Fashola said that Princess Adeniran-Ogunsanya brought her rich experience to bear while serving as the Secretary to the State Government in the Class of 2007-2011 in the Lagos State Cabinet which he had the privilege to lead.

While praying that Almighty God will grant the immediate family members of the deceased the fortitude to bear the sad loss, Fashola implored them to take solace in the fact that Princess Adeniran-Ogunsanya throughout her earthly sojourn bore aloft and admirably without stain the banner of committed public service for which the family had always been known.   He also prayed that Almighty God grants her soul peaceful repose.

The Highway Development Management Initiative Ministerial Notice Delivered By H.E Babatunde Raji Fashola, San At The Conference Hall Of The Ministry Of Works And Housing On Tuesday, 22nd March 2021

Distinguished Ladies and Gentlemen,

Our Permanent Secretary has already welcomed you all to this event, the official ministerial notice of the commencement of the Highway Development Management Initiative (HDMI).

What remains for me to do is to get on with the business of issuing the notice for the HDMI to commence the procurement process; after a few preliminary remarks.

As you all know, one of the early initiatives of the Buhari administration was to improve the ease of doing business, and it is no secret that infrastructure was going to be an important driver of this initiative.

Since 2015, the administration has made no pretence about its commitment to improve the stock of infrastructure both in qualitative and quantitative terms in many sectors from roads and bridges, to rail, airports and seaports to mention a few.

Currently the government is executing over 700 different contracts which aggregates to the rehabilitation and reconstruction of over 13,000 km of roads and bridges across all the 36 states including the Federal Capital Territory.

As a result of the size of the undertaking, there is an increasing and unsatisfied demand for funding to finance these projects to completion and to maintain them.

There is also the need to finance other complementary services like weigh bridges, rest houses, towing vehicles and road furniture which seem better suited for the commercial initiative of the private sector.

In the interim, government is constrained to borrow, offer tax credit, increase her revenue mobilization capacities in order to sustain this massive infrastructure renaissance.

This is the background to the HDMI which is another effort to mobilize private capacity, resources, and entrepreneurship into the Nigerian highway sector; and hopefully convert roads from just social assets into assets of commercial opportunities and enterprise.

The HDMI is made up of 2 categories namely the Value-added Concessions (VAC) and the Unbundled Assets Approvals (UAA).

The UAA provides opportunity for small businesses to take advantage of the commercial opportunities that are available along the ROW while under the VAC the road pavement and entire right of way is concessioned for development and management by the concessionaire .

The VAC will be rolled out in phases, and this First Phase involves 12 roads namely:

1.    BENIN – ASABA (125KM);

2.    ABUJA – LOKOJA (193KM);

3.    KANO – KATSINA (150KM);

4.    ONITSHA – OWERRI – ABA (161KM);

5.    SHAGAMU – BENIN (258KM);

6.    ABUJA – KEFFI – AKWANGA (122KM);

7.    KANO – MAIDUGURI (lot 1 Kano-Shuari 100KM ;

       lot 2 Potiskum-Damaturu 96.24KM )

8.    LOKOJA – BENIN (270KM);

9.    ENUGU – PORT HARCOURT (200KM); 

10.    ILORIN – JEBBA (129KM);

11.    LAGOS – OTA – ABEOKUTA (80KM);

12.    LAGOS – BADAGRY (79KM)

These 12 roads were carefully chosen to ensure that each of the 6 (SIX) geo political zones are covered.

They aggregate in total to 1963.24 km which is 5.6% of the 35,000 km Federal road network.

The initial capital investments that we foresee is something in the order of NGN 1,134,690,048,000.76 and the employment potentials are an estimated 50,000+ direct jobs and 200,000+ indirect jobs.

The process started on the 17th June 2020 with legislative consultation to get parliamentary support and endorsement which I believe was successful and we are assured that if there is need for legislative support, the response will be reasonably swift.

It was followed by a Stakeholder consultation (webinar) which held on the 25th June, 2020 with Over 1,173 participants including critical stakeholders such as legislative representatives, representatives from the executive, prospective concessionaires, road users, media and industry experts;  a market sounding session was also held on the 31st August, 2020 with 162 participants. 

In the course of this journey, we have struck strategic partnerships with some high-profile brands who have offered their services in various aspects of the project development such as KPMG, UK NIAF, Lagos Business School etc.

We look forward to further exploring and strengthening these partnerships and the clear terms of the relationships will be notified to the public in due course as they are important to the success that we expect.

As published, not only has the right of way of the 12 roads been fully gazetted, the Infrastructure Concession Regulatory Commission (ICRC) , as a regulatory body for concessions of this nature, has issued the Certificate of Compliance for the Outline Business Case that is necessary to commence the process.

On the 3rd of March 2021, the Federal Executive Council (FEC), the highest executive decision-making organ of the Nigerian Federal Government was notified about the commencement of the procurement process.

In order to ensure competitiveness and to guarantee transparency, a procurement portal has been developed to serve as the interface with the public and manage the HDMI from Procurement to Implementation.

The portal will provide:

a.    An  interface that will provide the public all the information they need to know about the Initiative. It will give access to relevant documents, news updates, videos and so on;

b.    E-procurement – The management of the PPP procurement  process of the VAC and the process of approvals and permits under the UAA;

c.    Vendor Market Place – This has specifically been included to promote local businesses and vendor partnerships with prospective concessionaires.

Therefore, let me say to all those who have been writing letters of inquiry, making offers of interest on the HDMI, offering to provide services like tolling, weigh bridge, rest houses and so on; we are sorry we cannot respond to those letters in order to maintain the integrity of this process and to keep the playing field level.

To all of you and to those who have not written or called, the day is now upon us, the venue is fixed and I have the pleasure to announce that the HDMI portal https://hdmi.worksandhousing.gov.ng/)  will open on Monday the 29th March, 2021.

The portal will be open for all HDMI related functions as earlier stated and most importantly   the RFQ application for the VAC which will be officially advertised on the same day.

Please visit the portal and I wish you all a very interactive and rewarding experience.

Let me repeat that all our transactions will be done through this portal and we will not entertain any personal inquiries to me or to any of our staff who have correspondingly been mandated not to entertain such requests.

Let me conclude by saying that we expect a vibrant process and a successful one that unleashes the commercial opportunities on Nigerian highways from paved roads, to clean and well-maintained highways, proper signage and route assurance signs, rest houses and commuter support for emergencies like vehicle towing and repairs.

We expect a splendid and safer commuting experience for all users of these roads as a result of the HDMI.

I thank all members of the Ministry and the ICRC and our partners especially KPMG and UKNIAF who worked tirelessly to bring us so far and urge them to prepare for more hard work in weeks and months ahead in order to bring this initiative to conclusion. More grease to their very hardworking elbows.
